About the Workshop

This workshop will provide a practical overview of the professional liability landscape in the UAE, with a particular focus on the legal basis of liability for professionals and the differences between the UAE onshore regime and the common law frameworks applicable in the DIFC and ADGM. The workshop will explore key legal and practical considerations in managing professional risks and claims, supported by real-life case studies, including those arising in the construction sector. It will  also  provide  an  overview  of  professional  indemnity  insurance  and  its  role  in  managing  professional risk.

Objectives

The participants will gain better understanding of:

  • The professional liability landscape in the Middle East, including the principal jurisdictional and  governing  law  considerations  across  onshore  civil  law  courts,  offshore  common  law courts, and arbitration
  • The legal basis of professional liability under UAE law and the DIFC/ADGM framework, including duty and standard of care, breach, causation, damage, contractual liability, and tortious liability.
  • The key principles relevant to professional liability claims, including contractual and tortious liability, duty and standard of care, breach, causation and damage.
  • Practical risk mitigation measures, including terms of engagement and limitation and exclusion of liability clauses.
  • The practical lifecycle of professional liability claims through worked real-life case studies and the key lessons arising from such claims.
  • The particular considerations arising in professional liability claims against architects and engineers in the construction sector.
  • Professional indemnity insurance as a product, including key coverage considerations and relevant regional considerations.
